SENATE CONCURRENT RESOLUTION NO. 89
(By Senators Kessler, Foster, Minard, Barnes, Caruth, Harrison,
Lanham and Weeks)
[Originating in the Committee on the Judiciary;
reported April 1, 2005.]
Requesting the Joint Committee on Government and Finance study the
tax laws relating to property taxes and consider revisions to
the state's tax laws.
Whereas, The Legislature finds and declares that all property
in this state should be fairly and equitably valued wherever it is
situated so that all citizens may benefit therefrom; and
Whereas, The tax laws of West Virginia need to be modified to
better meet the fiscal challenges and changing needs of
populations, infrastructure, services and future development of the
state and its subdivisions and to ease the financial burdens of its
citizens who are already overly tax-burdened; and
Whereas, Changing the standard methods of taxing property, as
well as considering the concept of land value taxation, may lead
to changes in the state's tax structure which may result in the
elimination or reduction of other taxes; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby
requested to study the tax laws relating to property taxes and
consider revisions to the state's tax laws; and, be it
Further Resolved, That the Joint Committee on Government and
Finance report to the regular session of the Legislature, 2006, on
its findings, conclusions and recommendations, together with drafts
of any legislation necessary to effectuate its recommendations;
and, be it
Further Resolved, That the expenses necessary to conduct this
study, to prepare a report and to draft necessary legislation be
paid from legislative appropriations to the Joint Committee on
Government and Finance.
